In NCAA v. Alston, the Supreme Court, in a 9-0 opinion written by Justice Gorsuch, ruled in favor of student-athletes and against the NCAA on the issue of whether the restriction of education-related benefits violated antitrust law.
The Court’s opinion was consistent with several of the points Prof. Michael Carrier and Chris Sagers made in an amicus brief filed on behalf of 65 professors. The Court also cited the brief for Prof. Carrier’s empirical review of Rule-of-Reason cases (a project going back 20 years!) showing that plaintiffs almost never win at the first stage, which revealed that the anticompetitive effect suffered by the players in this case was not typical.
